Mr. Sandler (Chairman) called the meeting to order at 7:00 PM.
Approval Not Required:
CASE PB#2004-08 - BELL/DELCOURT/HINES, 2075 State Highway / 755 Lucinda Court, Eastham, MA - Map 015 Parcels 146 & 147.
Chet Lay (Surveyor) presented an overview of the request to reconfigure existing lot line.
A MOTION was made by Ms. Morse, seconded by Mr. Nightingale to endorse the ANR plan.
VOTE: Unanimous (6-0): Sandler, Abbott, Cole, McDonald, Morse, and Nightingale
Mr. Klink and Mr. McDonald recused themselves from discussion on Cases PB#2004-06 & 07
New Hearing - Residential Site Plan Approval
CASE PB#2004-06 - HVM HOLDINGS, LLC / LAND CAPE INC., 5 Deer Trail Road, Saddle River, NJ 07458, request Residential Site Plan Approval under Eastham Zoning By-Laws Section XIV, to construct new two-story residential dwelling, resulting in Site Coverage exceeding 3,000 sq. ft. for property located at 90 Blueberry Drive, Eastham, Map 21 Parcels 44 & 45.
Applicant sent in a letter requesting a continuance to revise plan.
A MOTION was made by Ms. Morse, seconded by Mr. Nightingale to continue hearing to May 12, 2004 so the applicant can make design changes. VOTE: Unanimous (5-0): Sandler, Abbott, Cole, Morse, and Nightingale
New Hearing - Residential Site Plan Approval
CASE PB#2004-07 - WALTER & MARY MAKAR, 60 Pleasant Street, Berlin, MA 01503, request Residential Site Plan Approval under Eastham Zoning By-Laws Section XIV to construct new two-story residential dwelling resulting in a Site Coverage Ratio exceeding 15% of the lot area for property located at 220 Pierce Road, Eastham, Map 04 Parcel 526.
Applicant sent in a letter requesting a continuance to revise plan.
A MOTION was made by Ms. Morse, seconded by Mr. Cole to continue hearing to May 12, 2004 so the applicant can make design changes. VOTE: Unanimous (5-0): Sandler, Abbott, Cole, Morse, and Nightingale.
Mr. Klink and Mr. McDonald rejoined the Board.
Site Plan Approval - Special Permit - Waiver Request
CASE PB#2004-10 - GERALDINE D. LAPIANA/LANDMARK FENCE CO., PO Box 1014, N. Eastham, MA 02651, requests a waiver of Site Plan Approval requirements under Eastham Zoning By-Laws Section XIII-D, to add sheds for display on property located at 4550 State Highway, Eastham, Map 08 Parcel 193B.
Wayne Pratt (Landmark Fence) presented overview of waiver request. The Chair asked if there was any public comment on this request, and there was none.
A MOTION was made by Ms. Morse, seconded by Ms. Abbott to Approve Waiver of the requirements for Site Plan Approval - Special Permit to add sheds for display on property located at 4550 State Highway, Eastham, Map 08 Parcel 193B upon the Condition: No more than three (3) sheds be displayed. VOTE: Unanimous (6-0): Sandler, Abbott, Cole, McDonald, Morse, and Nightingale.
Other Business
Preliminary Discussion - 2 Marion’s Way - Burton Spottiswoode presented an overview of his proposed project to build a new house with approximately 2,800 square feet of Site Coverage on a lot of about 9,900 square feet. Mr. Spottiswoode informed the Board that he had already demolished the existing house. Several members of the Board expressed their concerns and opinion that he has jeopardized his “grandfathering” by demolishing the preexisting nonconforming structure. The Board also expressed concerns with the scale of the proposed request, since it is more than three times that of the original structure. Tim Klink also noted that approval form the Board of Health will be required for this project. The Board suggested Mr. Spottiswoode obtain legal counsel
before proceeding further.
Residential Site Plan Approval - The Board discussed a proposal by staff to streamline review of residential project requiring approvals from both the Planning Board and Zoning Board of Appeals (ZBA). Since the implementation of Section XIV - Residential Site Plan Approval (RSPA) in the Eastham Zoning Bylaws, numerous residential projects, particularly those on lots with less than 20,000 square feet of area, have met the RSPA review thresholds established in Section IX (D) and failed the “increase in non-conformancy test” spelled out in Section VI (C) (1) & (2). This common situation has, and will continue, to require applicants to obtain Residential Site Plan Approval from the Planning Board and a Special Permit from the Zoning Board of Appeals (ZBA) for certain residential
projects. The Planning Board decided to set up a meeting with the ZBA to discuss this topic further.

A MOTION was made by Ms. Morse, seconded by Mr. Cole to accept the minutes of the March 10, 2004 meeting as drafted. VOTE: Unanimous (6-0): Sandler, Abbott, Cole, McDonald, Morse, and Nightingale
